Abstract [eng] The freedom of contract is a legal principle which guarantees that parties are able to establish, change or eliminate contracts without restrictions of will. Nonetheless, the true intentions of a person's will might be influenced by external or internal factors leading to commit the contract which does not reflect the real intentions of a contract party. In such cases the importance of invalidity of transactions of will is crucial. For this reason, this thesis object is the invalidity of the transactions with flaw in will. The master’s thesis reveals the impotarance of invalidity of transactions in Lithuania. The basics of transactions related to the will or expression of the will invalidity are revealed by evaluation of Soupreme Court of Lithuania decisions. Comparison of regulation in different European countries leads to conclusions on possible regulatory improvements. Also, the effectiveness of restitution, as the general and main consequence of invalidity of the transaction, is analyzed towards the contract parties and third persons.
