Abstract [eng] The dissertation analyses problematic issues pertaining to application of civil liability for the damages caused by unfair competition actions occurring as unlawful disclosure, use, public disclosure or acquisition of a trade secret. In view of the fact that the said actions of unfair competition are associated with the specific object, i.e. a trade secret, the thesis primarily focuses on the issues concerning the legal protection of trade secrets, examines the legal nature and content of the obligation to keep a trade secret confidential, and validity of this obligation in terms of time, territory and market. The dissertation also reveals aims of the institute of protection against unfair competition, the content of the prohibition of unfair competition, and analyses the relation between the institutes of the legal protection of a trade secret and the protection against unfair competition. The dissertation offers an analysis of conditions for application of civil liability for the damages caused by actions of unfair competition, and the problematic issues involved. A special focus is on the unlawful actions, damages and its determining based on different forms of redress as well as the interrelation of those forms. The thesis also discusses what persons can be held liable for the damages caused by the actions of unfair competition analysed in the dissertation.
