The dissertation aims to disclose the nature of sport activity contract according to Lithuanian and foreign countries laws, case law of different countries and legal doctrine and to determine which law branch norms should regulate the relations and how to solve disputes arrising from these relations. In the first chapter are analyzed the characteristics of sport activity contract, revealed it, labour and civil contracts uniting and separating features. Discussed to which law branch in foreign countries law and case law is assigned to regulate the relations arising under sport activity contract and is analyzed is sport activity contract party, i.e., professional sportsman and sport club can be equate to labour relations parties. The second chapter of this dissertation discusses the sport activity contract implementation singularities, potential sport activity contract amendments and termination cases. It also analyzes sport activity contract’s form, content and according to concrete professional sportsmen sport activity contracts are revealed separate contracts conditions, possible violations of these contracts and liability. The third chapter deals with sport disputes settlement singularities. As the sport dispute definition is not set in Lithuanian legislation so in this chapter is revealed what should be considered as sport disputes and disclosed possible solutions ways. This chapter analyzes what sport dispute settlement model would be the best for Lithuania. |
