Abstract [eng] |
The purpose of the dissertation is to examine the economic approach to vertical agreements which have as their very object the restriction of competition and historically were treated very negatively by the European Courts, the European Commission and the national authorities. The research focuses on the two types of such agreements – resale price maintenance and absolute territorial protection. The author argues that it is time to depart from the formalistic evaluation of these vertical agreements and endorse economic analysis which shows that such agreements cannot be always considered as harmful to the consumers and the competitive process. The analysis concentrates on the European Union, United States and Lithuanian legislation and court practice. The dissertation consists of four main parts. The first part is dedicated to examination of the goals of European Union and Lithuanian competition law. The second part provides a legal and economic background of the assessment of vertical agreements. The third and fourth parts analyse in detail the features and practice of specific vertical restraints - vertical price fixing and absolute territorial protection. Relying on the performed research the author provides conclusions and proposals for future competition law enforcement. |
