The master 's thesis analyzes the problems of VAT on new immovable property in the context of the VAT Directive and the Lithuanian VAT Law. The topic of the work is revealed first by presenting the sources of VAT on immovable property taxation in the EU, further analyzing how the provisions of the VAT Directive are transposed into Lithuanian VAT law and whether such transposition complies with the principles of the common VAT system, especially fiscal neutrality, fairness, reasonableness and avoidance of double taxation. The following problems are analyzed in the work: 1) sales of new immovable property in a two-year period, when immovable property "goes out" and returns to the commercial circle 2) interpretation of the concept of substantial improvement in the Lithuanian VAT Law and the VAT Law Commentary, 3) an analysis of Rent to buy transactions as a new way of acquiring real estate and assessing whether such a transaction can be regarded as a supply of goods immediately or first as a lease and then as a supply of goods. The paper presents possible alternatives for the improvement of the new immovable property VAT regulation. |
