In the master thesis the author analyzes the regulation of the principle of racial equality and the prohibition of racial discrimination, the scope of this international regulation and evaluates its possibilities to combat racial inequality in the context of European migration crisis and digital technologies. To this end, the thesis provides a coherent overview of key international legislation. In this respect, it is shown that the legal response to racial inequality at international, European Union and Council of Europe level is based on the implementation of the principle of equality and the prohibition of racial discrimination, and the significance and limits of formal and substantive equality are assessed. Based on the view that the regulation in question and its implementation do not ensure the achievement of complete racial equality in practice, the thesis makes further proposals for improving regulation and its practical implementation at international and national level, taking into account the framework of racial discrimination, state responsibilities and currently widespread and serious human rights harm inflicting forms of racial inequality (institutional racism). Emphasis is placed on the rejection of racial ideologies, the integration of equality responsibilities in the private and public sectors, the need to involve those affected by racial inequality in decision-making and policy-making proccesses, and the need to achieve equal opportunities and equal outcomes. Finally, in order to fully address the issue of racial inequality, the paper presents an assessment of this issue in the context of the European migration crisis and the development of digital technologies. |
