This work explores the current patent law issues arising from the recognition that artificial intelligence can independently create inventions without human intervention, and analyses decisions of the patent offices and decisions of courts in various jurisdictions that provide interpretations on whether artificial intelligence can be an inventor. It is also proposed to allow, based on patent law theories and doctrinal assessments, to designate artificial intelligence as the inventor and to transfer intellectual property rights to natural or legal persons representing the artificial intelligence. |
