The Master's thesis analyses the types of state pensions and the problems of legal regulation of these pensions. In the first part of the thesis, analysing the concept of social security and the components of the social security system, we have found out that state pensions (special benefits) are one of the elements of social security that do not receive as much attention as social insurance and social assistance. In the second part of the paper, we have analysed the national legislation of the Republic of Lithuania and the jurisprudence of the Constitutional Court to find out what kind of benefits are covered by the concept of state pensions. State pensions include: state pensions of the first and second degree, the state pension of injured persons, the state pension of soldiers and officers, the state pension of judges, the state pension of scientists and the state pension of the spouse of the President of the Republic of Lithuania. The examination of each of the state pensions revealed gaps in the legal regulation, violations of the law, such as violations of the Constitutional principles of equality, equal treatment and non-discrimination of persons and their origins. The third part of the Master's thesis presented the problems and shortcomings of the state pension system of the Republic of Lithuania as a whole, as well as a comparison of state pensions with each other, as a result of which the fundamental problem of the state pension system became apparent. |
