In the master's thesis are analyzed the peculiarities of the employment contract with the head of a public legal entity. The topic of the work is analyzed by researching two areas - education and health care. In the final work, the topic is revealed by analyzing the latest case law, researching the problems found in the legal regulation and explaining the theoretical aspects. The first part of the work reveals the dualistic legal status of the head of public legal entity and what problems arise from such a legal status. In the master's thesis are also examined the concept of a manager of a public legal entity and its differences from a private legal entity.In the first part of the work are disclosed and analyzed the rights and responsibilities of the manager under various legal acts. The second part of the final work analyzes the peculiarities of the employment contract with the heads of public health care and education. Peculiarities are examined during the employment contract pre-contractual relations, conclusion, execution, removal of the manager from office and formalization of the termination of the employment relationship. The peculiarities are revealed by examining the latest case law, legal regulation and the problems that are found in the legislation. The second part presents the differences in legal regulation, the founder of some institution is the state or municipality and when the founder is a private legal or individual, and how these differences can be practiced and what problems are perceived in legal regulation. The last part of the work reveals the property responsibility of the managers of a public legal entity in the field of health care and education and how it manifests itself in practice in the dualistic status of the head of a public legal entity. The property liability of the head of a public legal entity is investigated in the above areas through the norms of civil and labor law. |
