The goal of master work is to reveal and to analyze the peculiarities of disciplinary liability, also to compare the disciplinary liability with administrative, criminal, civil, legal liability according to labour law and state service liability. The master work deals with the problems that are related to the concept of disciplinary liability, the legal principles of disciplinary liability and the finding of the disciplinary relation with other types of legal liability (administrative, criminal, civil, legal liability according labour law and state service liability). Unfortunately, there is no Lithuanian law academics discussion related with the disciplinary liability concept, equally there is no comprehensive analyze of disciplinary liability relation with other types of legal liability in legal literature. Therefore the master work formulates the original concept of disciplinary liability. The author suggests to define disciplinary liability as the separate type of legal liability, which can be applied only by the employer to the employee who has committed a breach of labour discipline, thereby the employer imposes a disciplinary sanction according to procedures, which are defined by the Labour Code and other laws, legal acts. Moreover, in the fourth part of the master work, author pays attention not only to the original finding of the disciplinary relation with administrative, criminal, civil, legal liability according labour law and state service liability, but also to the other aspects of this relation. |
