Abstract [eng] |
The work analyses the definitions of special knowledge, given by different authors – the differences between various conceptions and common essential features. The study of legal knowledge includes analysing the conception of rules which have legal form and technical content. The paper also describes the attempts of scientists to define legal knowledge as professional ones. The work draws a conclusion that exists a field of knowledge which is common both to legal and special knowledge. This field is determined by legal form and specific content of certain rules. The analysis of delimitation issues is executed in the context of road accident reconstruction and work security examination. This part of the paper contains the assignment of particular questions (breach of rules, causes of accidents etc.) to the field of certain knowledge. Summing-up legal conclusion is drawn on the ground of technical version. This proposition is true only under condition of thorough, valid and reasoned examination. The final part determines the consequences of inaccurate delimitation. |
