UNIDROIT Principles of International Commercial Contracts – one of the most modern instruments of general contract law. 1994 edition of the UNIDROIT Principles appeared exactly when Lithuania’s contract law has been created. As a result, most of provisions of UNIDROIT Principles were incorporated into Civil Code of Lithuania. But it wasn’t the end of international unification of general contract law, so after ten years appeared new edition of UNIDROIT Principles. UNIDROIT Principles 2004 were enlarged in such items: authority of agents, third party rights, set-off, assignment of rights, transfer of obligations and assignment of contract, limitation periods. The first part of the thesis deals with the issues of significance of UNIDROIT Principles vis-à-vis Lithuanian Civil Law, e.g. it is discussed what impact first edition of UNIDROIT Principles have had in creating Civil Code of Lithuania. The second part of the thesis deals with the issues related to separate items of second edition of UNIDROIT Principles in regard to Lithuanian civil law. In analyzing separate items it is highlighting differences and similarities that can be found in provisions and its comments of UNIDROIT Principles 2004 and Civil code. In this part is also analysed concepts of Lithuanian Supreme Court. |
