Common issues of jurisdiction in civil procedure of European Union The legal ground for the states to institute the cooperation on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters was Article 220 of the Treaty establishing European Economic Community (EEC) by virtue of which they undertook to secure the simplification of formalities governing the reciprocal recognition and enforcement of judgments of courts. The Regulation 44/2001, which has changed The Brussels Convention, covered many of legal gaps in the regulation of jurisdiction, which were effectively filled by the autonomous Brussels Convention interpretation by the European Court of Justice (ECJ) before. The Regulation 44/2001 provides detailed conceptions of place, in which contract has to be performed and of domicile of the legal persons, renews regulation of jurisdiction over individual contracts of employment and determines the moment of when a court shall be deemed to be seised. |
