Abstract [eng] |
In comparison to other European Union member states, Lithuania has one of the highest numbers of prisoners, while European Union legislation and institutional recommendations encourage reducing the number of individuals in places of deprivation of liberty and promoting a more effective rehabilitation process for convicted individuals. The master's thesis delves into the issues surrounding the suspension of sentences for adults, analyzing Article 75 of the Criminal Code, scholarly publications, and legal interpretations provided in judicial practice. The conceptualization and evolution of sentence suspension are examined in the thesis, along with an analysis of Article 75 of the Criminal Code. The author also explores the possibilities of applying sentence suspension for individuals convicted of very serious crimes based on Constitutional Court interpretations. Additionally, attention is drawn to the legal consequences of non-compliance with punitive measures and obligations after the suspension of sentence execution. Finally, conclusions are provided. |
