In this master's thesis, analyzing the origins of the special witness institute, the intentions of the legislator in consolidating this procedural entity in the legal system of the Republic of Lithuania and the valid legal regulation, the concept of a special witness is presented. Special witness is also compared to similar institutes in Republic of France as well as Republic of Italy. The paper discusses the role of the special witness in the context of witness and suspect. Moreover, the problematic aspects of ensuring the rights of a special witness are revealed in this thesis by naming and discussing the rights and duties of mentioned criminal procedure institute and analyzing the theoretical and practical challenges faced in ensuring the proper realization of the rights of a special witness. Based on the analysis made in this master's thesis, conclusions are made and suggestions for the legislator are given in order to improve legal regulation. |
