Abstract [eng] |
The master’s thesis "Single Criminal Act and its Types" analyses the concepts of single criminal offence presented by different authors, highlighting the main features of this of-fence. Since the criminal law does not provide a concept of a continuing offence and since the courts interpret and apply these elements differently in different categories of criminal cases, the paper identifies the main and additional elements of a continuing offence. The master’s thesis analyses extensively the composite offence and its types. Based on the ex-amples of the practice of the Supreme Court of Lithuania, each type of a single criminal offence is analyzed, and their problems are distinguished from other types of a single crim-inal offence. The paper also discusses the concept of coincidence of criminal acts by analyzing its features as presented in legal doctrine and case law. In addition, it discusses the concept of coincidence of criminal acts under the Criminal Code of the Lithuanian Soviet Socialist Republic of 1961, in comparison with the current concept of coincidence of criminal acts. Finally, an analysis of case-law provides the main criteria for distinguishing between an ideal and a real coincidence of criminal acts and a single criminal act. The focus is on the distinction between the ideal concurrence of criminal acts and the single criminal act and the composite criminal act. The distinction between a real concurrence of criminal acts and a continuous criminal act is also extensively analyzed. |
