The master thesis provides the analysis of unlawful defense measures and its legal consequences of their use in the Criminal Procedure of Lithuania. In this thesis it is widely discussed the general conception of criminal defense measures, broadly considered the unlawful defense measures and its legal consequences of criminal defense lawyer in the aspects of statutory law, case law and doctrine of law. In this work it is widely invoked the legal jurisprudence of The Constitutional Court of the Republic of Lithuania, the weighty rulings of the Supreme Court of the Republic of Lithuania and ponderable legal works by influential and momentous authors of science of law of Criminal Procedure. It should be noted that both the general conception of defense measures and the topic of illegality of defense measures and the legal consequences caused by the use of illegal defense measures, in the context of the procedural activities of the defender, have not been widely studied in the criminal procedure law science of Lithuania. Thus, these topics are systematically distinguished and analyzed in the paper. The aim of the master thesis is to reveal the interrelationship between the conception of the defense measures, the illegality of defense measures and the legal consequences of the use of illegal defense measures. The comprehensive analysis of these topics allows us to draw significant conclusions as to how the phenomenon of defense measures should be perceived, what manifests the illegality of defense measures applied by the criminal defense lawyer and what legal consequences affect the legal defender when the latter uses an illegal defense. |
