The subject of the legal status of the labor disputes commission is analyzed in the master's thesis, examining significant legal acts of the Republic of Lithuania, publications by scientists, interpretations presented in court practice and decisions of the labor disputes commission. The legal status of the labor disputes commission is its identity, which is revealed through the elements of the legal status. This Master’s work analyzes the development of labor disputes regarding legal examination in the labor disputes commission. Labor dispute commissions operating, which worked from the entry into force of the Labor Code of the Republic of Lithuania and until 2013 January 1, are described. It analyzes why the current regulation was ineffective and why reforms were necessary. The most significant reforms of the Labor Code are discussed, which changed the procedure for establishing the labor dispute commission, also expanded its competence, and equalized the rights as well as opportunities of employees and employers. The work investigates the concept of the labor dispute commission and the procedure for its establishment. The labor disputes commission is a mandatory pre-trial dispute resolution institution, where dispute resolution is not considered an alternative method of dispute resolution. The creation of a labor dispute commission on a tripartite basis allows the commissions to work more objectively, fully investigate the dispute and make an appropriate decision. The assignment examines the main rights and duties of the labor dispute commission. This writing analyzes how a labor dispute is initiated and examined due to the law in the labor disputes commission. It describes why the examination of labor disputes in the labor dispute commission is simpler, more accessible to a larger circle of people, cheaper and more efficient. The competence of the labor disputes commission is analyzed and examples of its decisions are presented. The work also focuses on the entry into force and implementation of the decision of the labor disputes commission. |
