This work analyses the public and national security exceptions that allow Member States to derogate from the requirements of European Union law. In order to explore the subject matter, the work analyses the meaning, scope, and implementation mechanism of national and public security exceptions. The implementation mechanism is explored through the prism of the principle of proportionality and the prohibition of economic expediency, as well as an analysis of Articles 346 and 347 of the Treaty on the Functioning of the European Union. Finally, following the results of the analysis of the first two parts of the work, the regulation of national and public security exceptions in the Republic of Lithuania is examined. |
