The aim of this master's thesis is to study the theoretical and practical aspects of the implementation of material responsibility of states in the recent jurisprudence of the International Court of Justice. The work begins with an overview of the concept of material responsibility of states and its significance for international law. Then, the jurisprudence of the ICJ, which is most relevant to this topic, is identified, and the trends related to the citation of the decisions of the International Court of Justice are analyzed. After that, this thesis examines the significance of these trends for the development of international law in relation to states' material responsibility. This thesis also aims to clarify the problematic issues of the implementation of the material responsibility of states, which the ICJ faces in reparations, compensations, and restitution cases in the 2012-2022 period. This part of the thesis examines the significance of problematic issues of reparations, compensations, and restitution for the implementation of material responsibility of states. Finally, this section evaluates the challenges posed by these issues of responsibility enforcement and their implications for the development of international law. In addition, at the end of this thesis, the circumstances that could affect the scope of the states' material responsibility are discussed. For this purpose, several relevant ICJ decisions are analyzed, where it is possible to divide the analyzed circumstances into separate legal categories. The issue of the significance and influence of these circumstances on the development of international law in this area is also mentioned briefly. |
