This final master's thesis analyses the special legal regimes that are very relevant today in the peacetime of the Republic of Lithuania that is, state of emergency, emergency, and quarantine legal regimes. All these legal regimes are directly or indirectly derived from the Constitution of the Republic of Lithuania itself, with the aim of preserving the values protected in the Constitution, and the resulting obligation to the laws to regulate these special legal regimes in more detail in specific laws. Analysing in more detail, the circumstances are determined, due to which one or another special legal regime is introduced in the Republic of Lithuania, it is determined in which territories the introduction of these legal regimes is possible. Entities that introduce legal regimes for these admission procedures, for what period these legal regimes are introduced, as well as what implementation challenges and possible inaccuracies the entities face, what special measures are applied during different special legal regimes, who enforces them and what is their aim to preserve the values protected in the Constitution. Finally, the work analyses what Constitutional restrictions on personal rights are applied, what is their aspiration, because the threat to the values enshrined in the Constitution is the basis for restricting human rights enshrined in the Constitution. The work analyses the specific laws that regulate these legal regimes, a large contribution is made by the government, the resolutions of the Seimas introducing special legal regimes, the president, and other entities to introduce a special legal regime, a lot of work is being done, and for the further procedure. For a better understanding of the relationship with the Constitution, these procedures rely on the rulings of the Constitutional Court both in the context of the restriction of human rights and the application of special measures. Finally, it is possible to reach one of the essential conclusions that these special legal regimes are an inseparable legal instrument enshrined in the Constitution, aiming to save the state from a crisis situations. |
