Abstract [eng] SUMMARY The truth as proving purpose in the criminal process The most important part of a criminal process is proving process the main aim of which is to ascertain the truth. The main tendencies, structure and other factors related to truth are analyzed in the work. The definition of proving process, which is disclosed not only in historical point of view, is presented. The comparison of proving process of Lithuania with proving processes of other countries is presented. The proving process in a criminal process is compared with proving process in civil and administrative processes. The problem of a possible impartiality of investigators in proving process is defined. The proving process is revealed in stages: before-the-trial stage and investigation of a case in a court. Main aims, which should be gained in every proving process while gathering, presenting fixing and checking important data, are discussed. An investigation of gathered, presented or demanded and obtained by a court data during a judicial process, and recognition of data as evidences and estimation of evidences is disclosed. The aims of proving process are marked out in this work – to reveal and investigate offences as fast as possible; to define persons, suspects in making crimes or misdemeanor; to ensure a reimbursement of damage, made by a crime; to create necessary conditions for a case investigation in a court. The main aim of proving process was formulated – to ascertain the truth, which includes all the aims, tried to attempt during proving process. The concept of a truth and main truths, important in proving process: scientific, material, formal, objective, judicial, are given in this work. A brief statistics, revealing the success of proving process while investigating crimes at Panevėžys city chief police commissariat, is presented in this Masters’ work.
