Early Release from Imprisonment in Lithuania and Foreign Countries The master's thesis analyzes the application of parole from imprisonment in Lithuania and foreign countries, by analyzing significant legal acts, articles of Lithuanian and foreign scientists, court practice and by systematizing statistical data. This topic is revealed by discussing the concept and the system of the institute both in Lithuania and abroad also by distinguishing the conditions of application and problematic aspects. Probation is the execution of a custodial sentence. International legislation also states that it is an alternative to imprisonment in order to promote the re-socialization and integration of convicts into society. The need for alternatives to imprisonment dates back to the 19th century, when the number of prisoners in prisons was particularly high. This problem is also relevant in the 21st century, although in theory the states should have advanced and solved the problem, but based on statistical data, still high indicators of the prisoner population are recorded in the European countries. One of the reasons is the unchanging repressive criminal policy, which has resulted in imprisonment and longer sentences. The parole institute can not only solve the problem of prison overcrowding, but also can manage the damage caused by imprisonment, motivate convicts to change their behavior, promote their independence and most importantly ensure the full re-socialization and integration of convicts into society. Although the benefits of parole are undeniable, countries, including Lithuania, are still reluctant to use it. It is observed that the application of the institute is refused on the basis of subjective criteria - inappropriate behavior in prisons, high risk of repeated criminal behavior and lack of efforts to reduce it, unemployment and etc. Therefore the master's thesis analyzes the application practice of the institute of parole in Lithuania and abroad. The aim is to reveal the reasons for applying the institute, its benefits and problematic aspects. The aim is to find examples of good practice in foreign countries and Lithuania. |
