This paper analyses the negligent homicide committed by doctors and medical staff. The aim of the work is to analyse the practice of Lithuanian courts and scientific literature, to examine the peculiarities and the composition of irresponsible homicides of the cases when the subjects are doctors and medical staff. The first part of the master's thesis discusses the concept of negligent homicide and its historical development in Lithuania. The concept of negligent homicide, its features, and the specificity of negligent homicide is discussed. The second part of the main body is devoted to the analysis of objective and subjective characteristics of the negligent homicide, which includes the appropriate practice of Lithuanian courts and individual problems of negligent homicide qualification are distinguished. The third part of the work deals with the status of doctors and medical staff, which is equated with the status of a civil servant, which is analyzed according to the criteria for doctors and medical staff, who are equated with the status of a civil servant. The fourth part of the work analyzes the peculiarities of criminal liability of doctors and medical staff for negligent homicide in the practice of Lithuanian courts. Each part of the work distinguishes the most important problematic aspects of negligent homicide and negligent homicide, when the subjects of the crime are doctors and medical staff, and the author's position is reflected in the conclusion of the master's thesis. |
