This Master‘s Thesis analyses release from criminal liability on bail – a type of release from criminal liability set forth in the Article 40 of the Criminal Code of the Republic of Lithuania. The object of this analysis is made up of aforementioned law‘s regulation and the regulation‘s interpretation in the practice of The Supreme Court of Lithuanian Republic. The release from criminal liability on bail hasn‘t been thoroughly analyzed in the doctrine of the criminal law. This type of release from criminal liability has a vast theoretical possibility of application. Exactly for this reason this Master’s Thesis aims to conduct a thorough analysis of release from criminal liability on bail. Doctrine of the criminal law, which analyses the related subjects is used for this goal as well as for the identification of this law’s characteristics and concept. In the goal of gaining a better understanding of the subject’s importance, the goals of this law are analyzed. This Master’s Thesis analyses the conditions required to apply the release from criminal liability on bail and The Supreme Court’s understanding of these conditions. Furthermore, this Master’s Thesis analyses the practice of applying criminal measures in the cases, where people are released from criminal liability on bail. Because of this type of analysis the problematic aspects of this law’s regulation and it’s understanding in the practice of the courts are revealed. This thesis tries to offer possible solutions to these problems. |
