The issues that are examined in this master 's thesis clarifies, who should be given priority between the rights of the individual and the public interest in the context of a pandemic. Such a problem of identification stems from the uncertainty of concepts and their broad understanding. However, in order to determine them, three main criteria are used in the master's thesis: 1) the criteria of majority benefit 2) the interests of the person as criteria of his free choice 3) the basic rights of the person as similar criteria. The application of the priority between the public interest and the rights of the individual can be assessed in different ways, but during a pandemic, the most important duty of the state is to ensure the health of its population. For these reasons, this protection becomes in the public interest and, in order to be guaranteed, it must take precedence over other rights of the individual. |
