This paper analyses the standards of the European Court of Human Rights and the United Nations human rights institutions in ensuring the rights of LGBT + children. The paper reviews protection against discrimination on the grounds of gender identity and sexual orientation, as well as analyzes in detail the non-compliance of conversion therapy and its possible activities with international human rights standards, inter alia, the right to life, prohibition of torture, inhuman and degrading treatment, and the right to health. The paper also analyzes the right to information as an essential condition for the proper development of LGBT+ children. Paying particular attention to the existing legislation restricting distribution of LGBT+ content in some European countries as a violation of freedom of expression and the principle of non-discrimination, the thesis also analyzes right to sex education and the need to ensure comprehensive sex education for children, including the existence of objective information on LGBT+ identities in sex education programs, even in cases where the parents do not consent to the child receiving information relating to sexuality. In addition, this master's thesis reviews relevant aspects of the right to respect for private and family life: the issue of age of consent is analyzed in the context of when states decide to apply a different age limit to homosexual and heterosexual sexual relationships as a violation of the prohibition of discrimination. The thesis also covers an analysis of evolving international human rights standards related to gender - what are the responsibilities of states with regard to transsexual, nonbinary and intersex children. |
