Problems of Posting Lithuanian Workers to a Member State of the European Union This master thesis provides analysis of the problems of posting Lithuanian workers to a Member state of the European Union in the service provision system. It should be pointed out that posting is an institute of special importance, which enables entities of the Member States of the European Union to provide their services in other Member State of the European Union, thus having an opportunity to provide services to a wider market and for wider users of services. However, as analyzed in this master thesis, the posting institute also has some drawbacks – weak assurance of proper and equal working conditions for posted workers. The main and most common problems that have developed over a long period of time are identified and analyzed by examining European Union legislation, interpretations given by the Court of Justice of the European Union in pending cases, as well as by scholarly findings or research in legal doctrine. The work analyzes the concept of posting, enshrined in Lithuanian legal regulation and in the European Union legislation. Moreover, the development of legal relations in the framework of the legal regulation of posting in the service provision system is provided. In addition, the master paper examines how the Member States of the European Union have fulfilled their obligation to provide conditions, which are applicable for posted workers during their posting, clearly and easily accessible for posted workers and other subjects. Among other things, the problems faced by Lithuanian posted workers are identified not only in the field of access to information, but also in ensuring equal working conditions for posted workers. The work analyzes the problems of equal pay for equal work, proper, safe, healthy and hygienic working conditions, social security for posted workers and the problems faced by temporary agencies workers. |
