The master's thesis examines the topic of work and social insurance of persons from Ukraine and Belarus in Lithuania, using international bilateral agreements, relevant national legislation of the Republic of Lithuania, scientific conclusions, attention is also paid to the interpretation of decisions of courts and pre–trial institutions. The work is analyzed starting from the basics of employment in Lithuania, focusing on the work permit. The thesis examines the peculiarities of concluding an employment contract when concluding an employment contract with persons from Ukraine and Belarus. The Constitution of the Republic of Lithuania enshrines the right of every person to work and appropriate and safe working conditions, therefore the working conditions of persons are analyzed. The work also assesses whether appropriate conditions are created for individuals from Ukraine and Belarus to defend their violated rights, examines how the Constitution of the Republic of Lithuania protects the state – Lithuanian language. It also analyzes the jurisdiction over labor disputes and the essential difference between domicile and residence. The thesis reviews how many and which disputes were examined in the Labour Disputes Commission with persons from Ukraine and Belarus. It analyzes the conditions that must be met in order for an employee to be subject to property liability, and the criteria for determining the amount of damage caused. Possible problems with the enforcement of a judgment are also raised in order to recover the pecuniary damage awarded to the employee. It is assessed whether the Labor Disputes Commission is an institution of justice and whether its decision could be equated with a court decision in Ukraine and Belarus and whether it would be enforced. Cases of illegal employment and sanctions against employers are also discussed. The thesis examines the purpose and types of social insurance, its guarantees and the meaning of compulsory health insurance. |
