Social security is a set of measures that ensure that if a person loses funds, social security would be provided by the state. The purpose of social security is to distribute funds between able-bodied and incapacitated persons who, for reasons provided by law, are unable to earn a living. Social security consists of social insurance, social support, and special social benefits. Special benefits are state pensions that are paid from the state budget. The Republic of Lithuania has the following state pensions: first and second degrees of the Republic of Lithuania, state pensions of victims, officers and soldiers, scientists, judges, and the spouse of the President of the Republic of Lithuania. State pensions are granted for merits that are a reward for certain merits to the Lithuanian state. Occupational group pensions are rewards for a particular service or work of special significance and value. Pensions are like compensation, which is like remuneration for victims. There is a lot of debate about state pensions. Some scientists state that these pensions are privileged, but according to the Constitutional Court of the Republic of Lithuania, it is important to follow the principles of constitutional imperative, justice, reasonableness, and proportionality for state pensions so that it does not become a privilege, if these principles are followed, these pensions are not privileged. The circle of state pension recipients is unreasonably wide. It is stated that state pensions duplicate with state social insurance pensions, such regulation should be changed. The problem of duplication should be resolved and the circle of recipients of state pensions should be clarified, considering on every the legal basis of each of the recipients of state pensions. |
