Recognition of arbitration awards and permission for its enforcement The thesis analyses recognition of foreign arbitration awards and permission for their enforcement in Lithuania. The purpose of this thesis is to present the analysis of the Lithuanian case-law for the last 5-6 years in the field of recognition of foreign arbitration awards and permission for their enforcement; to measure the challenges in recognizing foreign arbitration awards and possible future prospects. The thesis consists of three parts. The first part of the thesis reveals the transnational character of the conception of the arbitration procedure, as an alternative dispute handling method; explains the conception of arbitration awards within the meaning of New York Convention; the conceptions of the award recognition and permission for its enforcement. The second part analyses the verification limits of foreign arbitration awards. The third part provides for a detailed analysis of the basis for rejection of the awards referred to in art. V of New York Convention and its application in the Lithuanian case-law. The thesis also provides for the findings covering all aspects of recognition of the foreign arbitration awards and permission for their enforcement defined in all three parts of the thesis. |
