Abstract [eng] This master‘s final paper gives the analysis of one of the most problematic spheres in law enforcement activity which deals with the application of the deed imitating a criminal act a measure of proof. With reference to the law, legal, notification literature, court praxis, the aspects of legal regulation and application in practice of this measure of proof are discussed upon. This final paper expounds in theory and praxis mostly debate raising questions on appropriate structural parts. The analysis discusses the conception of the application of the deed imitating a criminal act as a measure of proof, the development of legal regulation of such activities, the comparative analysis of provisions of the Criminal Proceedings Code of Republic of Lithuania and the Law on Surveillance Activities as they both regulates the application of this covert activity. A considerable attention is paid on determination of requirements of legality, validity of this measure of proof with reference to the jurisprudence of The Constitutional Court of Republic of Lithuania, Lithuania Supreme Court, The European Human Rights Court. A particular attention is paid to provocation problem, which is the main and the most problematic criterion of legality of the application of deed imitating criminal act and acknowledging the data received in the result of such conduct as evidence in the court.
