Abstract [eng] The Reform of Health Care System is being implemented in Lithuania now and this process is constantly discussed. Health Care Systems are criticized everywhere. The reason is simple – however good Health Care System would be operating, nevertheless people are getting ill and dying. People have bigger expectations in Health Care than they can be fulfilled. Any State cannot take a good care of every person's health as needs in this field are boundless. Article 53 of the Constitution of the Republic of Lithuania determines that the State shall take care of people's health and shall guarantee medical aid and services for the human being in the event of sickness. The procedure for providing medical aid to citizens free of charge at State medical establishments shall be established by law. Thus Article 53 of the Constitution of the Republic of Lithuania declares the Right to the Health Care. This article is also a directive provision, which directs to free of charge Health Care services and free of charge Health Care regulation by laws. The Reform of Health Care System is getting stuck. Basic prices for Health Care services, compiled by the Ministry of Health, are not reasoned economically nor related to the quality of services. Patients do not get quality Health Care services, they have to pay illegal surcharges under the necessity. This thesis is analysing the obligation of the State, set by Article 53 of the Constitution of the Republic of Lithuania, as well as legal provisions regulating Health Care, issues of regulation of free of charge Health Care services and implementations of the Right to the Health Care.
