Abstract [eng] The thesis of the master degree paper work is ''Legal Positivism Elements in the Lithuanian Legal Thought and Court Practice''. This work analyses the signs of legal positivism in the Lithuanian legal thought and case law. As legal positivism is a whole tradition of legal thought, it is necessary to define the most important positivism trends and general thesis, and to define which positivism strain is most actual to the analysed period. Three positivism trends are separated and disputed: classical positivism, modified positivism and socialistic positivism. All of these mentioned trends of positivism have common feature: separation and social fact thesis. Although, every strain has it’s specific propositions. Both, general and specific thesis, are used to find out if the positivistic ideas were supported in Lithuanian legal thought through interwar and soviet periods. The main attention of this work is tended towards searching the signs of positivism in legal thought and case – law of independent Lithuania. It is tried to define the attitude of Lithuanian legal scientists of nowadays about the doctrine of positivism. The signs of positivistic tradition are also searched in jurisprudence of the Constitutional Court, The Supreme Court and The Supreme Administrative Court of Lithuania.
