Individual labour disputes are solving in the two stages: pretrial and judicial. The labour disputes commissions represent the pretrial stage. The pretrial research is binding stage for the individual labour disputes. The part of individual labour disputes must be researched straight in the court, but it is the exception to the rule. When the dispute is settled in the labour disputes commission, it means that the dispute is settled peacefully and out of court. The main point of labour disputes commissions is to reconcile litigants, but the law do not secure this function, because the solving of labour dispute is in the first place. Peculiarities of research of individual labour disputes in the pretrial stage will be explained by analyzing the formation of labour disputes commission, hearing of application, making decision, appealing against the decision of commission ant enforcement of decision. |
