Illegal Work is a very relevant and a lot of discussions upraising problem. A proper way to determine the existence of Illegal Work is to comprehensively reveal the legal regulation of this phenomenon and the classification characteristics of this problem, by analysing the case law, national and international law. The Constitution of the Republic of Lithuania ensures the right to work principle, which expresses the fact, that every person may freely choose a job or business, and has the right to have a reasonable, safe and healthy working conditions, a fair pay for work and a social protection from unemployment. Illegal Work violates every person’s right to work and all the social guarantees, relating this right, which is infixed in the Constitution of the Republic of Lithuania. Illegal Work is considered as one of the most serious Labour Law‘s violations in the Code Of Administrative offences of the Republic of Lithuania, which violates the peremptory rules of law and the fundamental human rights. This violation does harm not only to the individual person, but also to the entire state of Lithuania. Legislator is trying to solve the illegal work problem by finding the best possible legal regulation of this phenomenon. |
