The academic research includes analysis of Lithuanian High Court cases on employee liability for employers damages. The academic research is constructed to analyze independents of the institute of employees liability in Lithuanian labor law and to introduce with basis and conditions of employee liability in Lithuanian High Court practice. The analysis of Lithuanian High Court cases reveals such compulsory conditions of employees liability: employers damages caused by illegal employee action, employee fault, causation between illegal action and damages, in a case of violation employee and employer were in employment contract, employers damages are caused by employees labor activity. All above mentioned conditions are necessary to state employees liability. The research includes analysis of employees limited liability and non pecuniary damages in Lithuanian High Court cases. The object of the analysis is formulates rules of Lithuanian High Court in cases of employees liability. Employee and employer have usually different economical, social, organizational opportunities, so if there were equal conditions for compensating damages, then social compromise could not be reached. It is necessary to create rules and conditions to find social compromise between two different parties of employment. The actual Lithuanian High Court practice formulated some rules of law, which stated that employee is weaker party in employment contract and labor activity therefore needs some additional defense even for employee liability. Employee is liable for damages incase if there are stated all above mentions conditions of employees liability. There is presumption of employees limited liability, employees full liability occurs if there is juridical facts stated in labor law. There isn’t extensive interpretation of full liability juridical facts in Lithuanian High Court practice. The analysis of Lithuanian High Court cases on employees liability opens some suggestions, how to improve the existing labor law and its application in practice. |
