Chosen problematic aspects of concluding electronic agreements are analyzed in this paper, at the same time searching for the possible solutions of the problems concerned. The identity of parties of electronic contracts, time and place of concluding electronic contract, incorporating terms of electronic contract in different ways, evidential value of electronic contracts, the concept of electronic signature, applicable law and jurisdiction of electronic contracts are discussed. The relevant international trends, international and national acts of law and experience of some foreign countries are taken into account when searching for the possible solutions of these problematic aspects. When comparatively analyzing the chosen problematic aspects of concluding electronic contracts, it is aimed to reveal the regulation of those countries, where the relevant rules differ the most in comparison to the legal rules that are in force in Lithuania. This way the problem of different regulation is highlighted in cases when electronic means are used to conclude a contract and the relevant applicable law is not the one of Lithuania. After the analysis, suggested solutions of the problematic aspects are presented. |
