Abstract [eng] The main source of Lithuanian labour law is the Labour Code of Lithuania, which was enforced on the first of January, 2003. But the Labour Code of Lithuania can not give absolute all work and social guarantees to the employers. Two social partners (employers from one side and employees from another) when signing the collective agreement negotiate the things, that are not regulated by the law. Collective labour relations ensure the equal position for both sides of collective agreement. It is obvious, that collective bargaining and collective agreement protect the rights of employees efectivelly. The other reason, why collective agreements are very important, is that the Labour Code of Lithuania can not foresee all the situations, that can happen in particular working place. Provisions of the collective agreement are related to the content of the employment contract. This article analyses the competition between norms of different sources of labour law. The conclusion of this work, is that the importance of collective agreement depends on the legal consciousness of the employer, on the activity of the trade union and also on the status of the working market.
