Abstract [eng] SUMMARY At all times, theft has been one of the most frequently committed crime actions not only in Lithuania, but also in other countries which violate the constitutional human right to property. Theft is a criminal action more commonly committed by the young persons. In 2009, theft made up about half (47.6 percent) of all criminal actions committed by the youth – 1915. The children are also most often the victims of theft and robbery. The paper presents a historical survey of laws regulating criminal liability for the theft in the Republic of Lithuania, reveals the theft concept, content, elements categorizing the theft, dissimilarities of theft from the other property offences and regulation and infliction of penalties for the theft by clarifying the content of legal norms, analysing the judicial practice, providing theoretical material and lawyers’ points of view and comparing the theft regulation in Lithuania and foreign countries, as well as, gives the conclusions made. The paper may be helpful in interpreting and applying in practice the criminal code provisions, when introducing the changes into the code of criminal law and as a tutorial for law students.
