Abstract [eng] |
This Master Theses deals with guarantees and remunerations for employees in the sphere of salaries. It should be noted that at present Lithuanian science of Law does not propose clearly defined conception of guarantees. This paper uses logical, linguistic, systematic, statistic and comparative analysis methods to review guarantees and remunerations for employees in the sphere of salaries defined by Chapter 15 of the Labour Code of the Republic of Lithuania. It compares definitions of guarantees and remunerations presented by Lithuanian and foreign scientists, describes their features, makes a definition of the concept of guarantees and remunerations which generalizes opinions of different scientists, analyses classifications of guarantees and remunerations, supplies analysis of theory and practice of guarantees and remunerations and a comparative table of kinds of guarantees, and discusses the importance of guarantees and remunerations for employees. On analysing guarantees and remunerations, the paper formulates clear and exact definitions of guarantees, guarantee payments, guarantee premiums and remunerations for employees, indicates kinds of guarantees and remuneration, which makes the paper original and important. In conclusion, it can be stated that it is not sufficient for the State to establish employee rights and liberties. The state, through its legislative bodies, has to ensure invulnerability of a private person, i.e. employee, as well as regulation of guarantees and remunerations, whereas in case of violations of labour law, the State has to guarantee defence and restoration of rights and remuneration for lost guarantees. |
