In the Master's thesis, the concept, significance, procedural and forensic characteristics, and issues of verification of testimony actions – identification, verification of testimony at the crime scene, and investigative experiment – are analyzed. The research examines both relevant legal acts and insights provided by psychology scholars, as well as clarifications presented in court practice and pre-trial investigation data. The topic is revealed through the prism of the preparation, execution, and recording stages of these actions, with considerable attention given to the psychological aspects influencing the reliability of the outcomes of testimony verification actions. The thesis also analyzes changes in the concept and regulation of testimony verification actions in the Republic of Lithuania over the past 60 years, during which the legal significance of these actions and their results has evolved, and the protection of the suspect’s rights has been established. Detailed attention is devoted to the procedural and tactical features of identifications, verification of testimony at the crime scene, and investigative experiments, which determine the effectiveness and reliability of their results. Additionally, by emphasizing the importance of psychology, the influence of psychophysiological factors on the organization and execution of each testimony verification action is analyzed, highlighting the necessity of general psychological knowledge for achieving complete and reliable results. An analysis of the legal acts of foreign countries (the USA (California), Kazakhstan, and Azerbaijan), where these procedural actions are regulated, allows conclusions to be drawn regarding the insufficient detail and shortcomings of the existing regulation in Lithuania. The analysis of the practice of the Supreme Court of Lithuania and lower courts, along with scientific literature, reveals problematic aspects of testimony verification actions, related to controllable factors – deficiencies in the control of law enforcement officers’ actions and in the legal regulation. |
