Abstract [eng] This Master's thesis analyses the relevance of the concept of vulnerable groups for the protection of the rights of asylum seekers and children under the ECHR. It examines the basis for the ECtHR's definition of vulnerability of asylum seekers and children. It explores whether the vulnerability of asylum seekers is considered universal in the ECtHR jurisprudence or whether it is subject to individual assessment and how the ECtHR's interpretation of the vulnerability of asylum seekers has changed. Furthermore, the paper analyses the relevance of vulnerability in the ECtHR jurisprudence for the application of interim measures in asylum seekers' cases. It also analyses the development of children's vulnerability in the ECtHR case law, its peculiarities and consistency of application. The study concludes that the ECtHR's case law on the vulnerability of asylum seekers is not consistent: while in the initial cases the ECtHR found that all asylum seekers as a group are vulnerable, in subsequent judgments individual reservations, the search for "additional vulnerability" and linguistic changes have appeared. In the case of children, the ECtHR has been more consistent in its interpretation of vulnerability, recognising their particular young age and dependence on adults, and the need for more stringent protection. The granting of vulnerable group status to children and asylum seekers has different meanings under the ECHR. For children, the jurisprudence of the ECtHR shows a clearer, more coherent and stricter approach to state obligations, while for asylum seekers, the regression of the concept of vulnerability creates the risk of legal uncertainty and weakens the enforcement of human rights protection in practice.
