The Master's thesis analyses the legal regulation of the insolvency of an employer as a legal person in the context of labour relations, examining the relevant legal acts, case law and scientific doctrine. The Master's thesis analyses the changes in the development of the concept of insolvency of an employer as a legal person during the periods of validity of the Laws on Bankruptcy of the Republic of Lithuania, on Restructuring of Enterprises of the Republic of Lithuania, and on the Laws on Insolvency of Legal Persons of the Republic of Lithuania. This study analyses the legal regulation of the insolvency of the employer as a legal person, distinguishing the main aspects of individual and collective labour relations, both from a theoretical and practical perspective. It assesses the characteristics of individual and collective labour relations in the context of an employer's insolvency process, and briefly analyses the specificities of labour relations in the context of restructuring. The study also analyses the legal uncertainties that arise in practice and affect the implementation of workers' rights. It reveals the main challenges related to the termination of employment contracts, the continuity of a legal entity, the settlement of employees in bankruptcy proceedings and the balancing of creditors' interests. It also analyses the potential impact of the application of restructuring clauses on employment relations. On the basis of a comprehensive analysis of legislation and case law, the aim is to provide an integrated approach to the legal regulation of employees in the insolvency process of a legal entity and to assess the effectiveness and efficiency of insolvency regulation. |
