Abstract [eng] In order to reveal the challenges related to the protection of human rights in the Lithuanian penal system, this master‘s thesis analyses the concept and purpose of imprisonment as a form of punishment, highlighting the evolving understanding of its purpose. Additionally, the concept of human rights and the different approaches to their classification are examined. The thesis also explores both international and national legal acts that establish the framework for the enforcement of custodial sentences and define the minimum standards for their implementation. The topic is developed based on universally accepted principles in respect for human rights and fundamental freedoms, emphasising that individuals sentenced to imprisonment lose only their right to freedom of movement, while all other rights remain in force and must be duly respected. The thesis analyses the case-law of national courts, the case-law of the European Court of Human Rights, as well as reports by the CPT and the Seimas Ombudsmen. These sources help identify and discuss the issues arising in the execution of custodial sentences that are related to human rights. The highlighted issues are closely connected to the most commonly restricted rights of prisoners – the right to health care, the right to education, the right to respect for private and family life – and also involve concerns related to the prohibition of torture and cruel, inhuman, or degrading treatment or punishment.
