In the Master's thesis, an analysis of the composition of a criminal association is conducted, encompassing the disclosure of its main and qualifying features, based on normative legal acts, specialized literature, and case law. The legal regulation and practical application of exemption from criminal liability and mitigation of punishment for individuals who have cooperated with law enforcement are also examined. Based on the analysis of Lithuanian case law, the concept of a criminal association and its essential and supplementary features are revealed, such as joint criminal activity, the number of participating individuals, the intent to commit one or more medium-gravity, serious, and very serious crimes, stable mutual relationships and the distribution of roles, leadership and organization, and armament. The analysis of the concept of a criminal association and its legal regulation is based on the doctrine of criminal law, comparing the provisions of the Criminal Code of the Republic of Lithuania with the Framework Decision of the Council of Europe. Through the analysis of Lithuanian case law, the basic composition and qualifying features of a criminal association are examined in detail. The problems of the practical application of exemption from criminal liability and mitigation of punishment are identified based on the provisions of the Criminal Code of the Republic of Lithuania, relevant decisions of case law, and the doctrine of criminal law. |
