This paper analyses the regulation and application in practice of one of the punitive measures – property confiscation. Changes in regulation and the influence of international and European Union legal acts on the regulation of property confiscation in national law are discussed. Not only property confiscation, as it is established in Article 72 of the Criminal Code of the Republic of Lithuania, but also the features of extended property confiscation and civil property confiscation are reviewed. Based on the formed case law, the main problems of the application of property confiscation are analysed. |
