Abstract [eng] The master's thesis examines the concept of the principle of justice, its place within the Lithuanian legal system, and its application in Lithuanian court practice. The concept of judicial discretion is also reviewed. The study aims to determine the role of the principle of justice in the application of judicial discretion in Lithuanian jurisprudence. It seeks to explore how this principle affects the justification of judicial decisions, their reasoning, and the boundaries of judicial responsibility. The research is based on the Constitution of the Republic of Lithuania, national legislation, constitutional doctrine, and court jurisprudence. Both theoretical foundations of the principle and practical examples from judicial decisions are analyzed. It is established that the principle of justice functions not only as a value-based guideline but also as a concrete tool for limiting and justifying judicial decisions, especially in cases where positive law allows for multiple interpretations of a legal norm. The findings reveal that the clear application of this principle enhances the transparency of decisions and strengthens public trust in the legal system.
