Abstract [eng] As environmental protection issues become increasingly pressing on a global scale, it is crucial to understand the principles upon which new international environmental legal regulation is being developed. One of the key institutions contributing to the formation and interpretation of international environmental law is the International Court of Justice (ICJ), which has played a significant role in the development of this legal field throughout its years of activity. This master's thesis analyzes the ICJ’s jurisprudence in the field of environmental protection and its impact on the evolution of international environmental law, with particular attention given to judgments concerning transboundary waterways, the protection of wildlife, and the consequences of climate change. The thesis also examines some of today’s most urgent environmental challenges—such as the environmental consequences of Russia’s war against Ukraine, as well as the destruction of ecosystems and loss of biodiversity. Furthermore, it compares the jurisdiction and case law of the ICJ with that of other international courts in order to assess the real impact of their decisions on the development of both international and national environmental law. The findings of this thesis demonstrate that the International Court of Justice contributes significantly to the development of international environmental law—its judgments and advisory opinions often serve as key references in legislative processes and legal doctrine. Together with other international courts, the ICJ helps to establish more coherent and consistent case law by reinforcing and clarifying the fundamental principles of environmental law. This interaction between international courts contributes to the development of a more mature international environmental legal framework, enhancing its clarity and authority.
