Abstract [eng] |
The master's thesis analyzes the importance of a judge's personality in the legal system, emphasizing ethical aspects and professional duties. The main attention is paid to the judge's moral values, ethics and the influence of cognitive processes on decision-making. The first part draws attention to the traits of a judge as a person, different personality types, value and moral attitudes and the role of emotional intelligence in decision-making. The second part delves into the professional duties, ethical standards and principles applied to judges, which aim to ensure correct decision-making, and reveals the challenges that arise in applying these principles in practice. The third part of the thesis examines the discoveries of neuroscience in the field of judicial decision-making. This part discusses cognitive biases, such as the confirmation heuristic, the anchor effect and the information sufficiency effect, which can affect the objectivity of a judge's decisions. Based on the insights of neuroscience, the influence of stress, emotions and cognitive processes on a judge's work is examined. The results of the work emphasize that the profession of a judge requires not only high legal qualifications, but also moral, ethical and emotional competencies. The fourth part analyzes the importance of comprehensive training of a judge, responding to the need to train a judge not only as a professional and expert in his field, but also as an emotionally educated lawyer guided by values and moral principles. |
